For years, a zoning decision (decyzja o warunkach zabudowy, WZ) was a permanent asset of a plot. Once obtained, it "worked" for the value of the property regardless of when the investor decided to build. Poland's spatial planning reform changes this. New WZ decisions expire after five years, and after 31 August 2026 – in municipalities without a general plan – new decisions will not be available. For the market for multifamily development land, this means a clear split between plots with a "strong" and a "weak" planning status.
What has changed
Limited validity. Under the amended Spatial Planning and Development Act, a zoning decision expires 5 years after the day it became final. Decisions that became final before 1 January 2026 remain valid indefinitely. Transitional provisions also set out special rules for proceedings started earlier – these are worth checking in each specific case.
WZ only within an infill development area. By the act of 30 April 2026, the deadline for adopting general plans was finally extended to 31 August 2026. From 1 September 2026, a WZ decision on an application filed after that date can only be issued for land located within an infill development area (obszar uzupełnienia zabudowy, OUZ) designated in the general plan. In municipalities that fail to adopt a general plan, new WZ decisions will, as a rule, not be available.
Proceedings started by 31 August are to be decided under the existing rules – even if the decision is issued later.
- until 31.12.2025Decisions that became final in this period remain valid indefinitely
- from 1.01.2026New decisions expire 5 years after becoming final (with exceptions under transitional provisions)
- 30.04.2026An act extends the deadline for general plans to 31 August 2026
- 31.08.2026Last day to apply for a WZ under the previous rules
- from 1.09.2026New WZ decisions only within an infill development area designated in the general plan
How this changes the value of plots with a WZ
A permanent WZ earns a premium. A plot with a final, open-ended WZ for multifamily housing is becoming an increasingly rare asset. A developer buying such land does not need to rush to obtain a building permit and can plan the project in line with the market cycle.
A time-limited WZ has a "clock". A decision valid for 5 years requires the developer to design the project and obtain a building permit within that time. The real window for buying the land is therefore shortened by the design and permitting period. A plot with a WZ that expires in two years is worth less to a developer than the same plot with a WZ valid for another four years.
Offers "with a WZ" need to be verified. For every plot offered "with a zoning decision", it is necessary to establish: the date the decision became final, its nature (time-limited or open-ended), the development parameters it allows, and whether it has been appealed.
- the developer plans the project in line with the market cycle
- increasingly rare – the price premium is growing
- what counts is the time left until it expires
- the developer must complete design and obtain a building permit in time
- after 31.08.2026, without a general plan – no route
- value depends on the future general plan
What is worth doing before 31 August 2026
For owners of plots without a local zoning plan, the coming weeks are crucial:
- Consider applying for a WZ. Proceedings started by 31 August continue under the existing rules. In a municipality that fails to adopt a general plan in time, this may be the only route to development rights for a long time.
- Prepare the application carefully. The date the proceedings start is what counts, but the decision must meet the statutory requirements – including the good-neighbourhood principle and access to a public road. An application for multifamily housing should be based on a realistic analysis of the surroundings.
- Check existing decisions. If the plot has a WZ, it is worth establishing its nature and expiry date – an important element of its future valuation.
- Assess whether selling now is more advantageous. If the plot has a final WZ for multifamily housing and the municipality faces a planning gap, developer demand for such land may rise significantly.
Kraków
In Kraków, the risk of a planning gap is particularly clear. The draft General Plan of the City of Kraków has not yet been made public, and the change of city leadership after the referendum of 24 May 2026 makes the timetable even harder to predict. Adoption of the general plan before 31 August is unlikely. This means that from 1 September, on the approx. 17.5% of the city's area not covered by local zoning plans, obtaining a new WZ decision will, as a rule, be impossible. Owners of such plots in Kraków should analyse their situation before the end of August.
Frequently asked questions
How long is a zoning decision valid?
WZ decisions issued under the new rules expire 5 years after the day they became final. Decisions that became final before 1 January 2026 remain valid indefinitely.
Can an application for a WZ be filed after 31 August 2026?
Yes, but the decision will only be issued for land within an infill development area designated in the general plan. In a municipality without a general plan, a new WZ will, as a rule, not be available.
Can a WZ decision be transferred to the buyer of a plot?
Yes. A zoning decision can be transferred to another person who accepts the conditions set out in it. This is a common element of plot sales to developers.
